Lexington County business owner arrested for failing to remit more than $84K in withholding tax

Roc Yauilla, the owner of Electrical Control Technologies in Lexington County, was arrested today by South Carolina Department of Revenue (SCDOR) investigators. He is charged with eight counts of failing to collect or pay withholding tax.

For tax years 2009 through 2016, Yauilla withheld taxes from his employees’ wages for state income tax purposes. However, the defendant failed to pay over the collected taxes and failed to file South Carolina Withholding Tax returns. During this period, wages totaling $1,649,223 were paid to employees. More than $84,400 in taxes were withheld from employees’ wages but were not remitted to the SCDOR.

Yauilla is currently being held at the Lexington County Detention Center. If convicted, he faces fines up to $10,000 and/or up to five years in prison per charge.

The SCDOR is committed to the fair administration of tax laws. By taking enforcement action against noncompliant taxpayers, the Department seeks to prevent unfairly increasing the tax burden on those who do comply.
